Terms of Service

These Terms of Service (“Terms”) govern your use of the mobile applications operated by SOO REAL LLC (“we,” “us,” or “our”), including Matcha World (collectively, the “Apps”). By creating an account or using our Apps, you agree to these Terms. If you do not agree, please do not use the Apps.

1. Eligibility

You must be at least 13 years old to use the Apps. By using the Apps, you represent that you meet this requirement and that the information you provide is accurate.

2. Your account

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to choose a username that is not misleading, offensive, or impersonating another person or entity. You may delete your account at any time from within the App.

3. User content

The Apps let you create content, including reviews, ratings, tasting notes, photos, and cafe entries (“User Content”). You retain ownership of your User Content. By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content within the Apps for the purpose of operating and providing the service. This license ends when you delete your User Content or your account, except that content you made public and that has become part of the shared map (such as a cafe you added or a public review) may remain available to other users in anonymized form, no longer linked to your account.

4. Content standards

You agree not to post User Content that:

is unlawful, harmful, threatening, abusive, harassing, defamatory, or hateful;
is sexually explicit, obscene, or otherwise objectionable;
infringes anyone’s intellectual property, privacy, or other rights;
is false, misleading, spam, or intended to deceive (including fake cafes or fake reviews);
contains malware, or attempts to interfere with or abuse the service.

We have zero tolerance for objectionable content and abusive behavior.

5. Moderation, reporting, and blocking

You can report content or users you believe violate these Terms, and you can block other users. We review reports and may remove content or take action on accounts. We may remove or hide any content, and suspend or terminate any account, at our discretion, particularly where content or behavior violates these Terms. We aim to act on reports of objectionable content promptly.

6. Acceptable use

You agree not to misuse the Apps, including by: attempting to access accounts or data that are not yours; scraping or harvesting data; overloading or disrupting the service; reverse engineering the Apps except as permitted by law; or using the Apps to violate any applicable law.

7. Location and third-party data

The Apps use your device location (with your permission) and third-party map and search data to help you find cafes. Cafe information may be incomplete or inaccurate, and we do not guarantee the accuracy of any location, address, or map data. Please use your own judgment.

8. Intellectual property

The Apps, including their design, features, and branding, are owned by SOO REAL LLC and protected by applicable laws. These Terms do not grant you any right to our trademarks or branding without our prior written permission.

9. Disclaimers

The Apps are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Apps will be uninterrupted, secure, or error-free, or that any content is accurate or reliable.

10. Limitation of liability

To the fullest extent permitted by law, SOO REAL LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Apps. Our total liability for any claim relating to the Apps will not exceed the greater of the amount you paid us, if any, in the twelve months before the claim, or twenty-five US dollars.

11. Indemnification

You agree to indemnify and hold harmless SOO REAL LLC from any claims, damages, or expenses arising from your User Content, your use of the Apps, or your violation of these Terms.

12. Termination

You may stop using the Apps and delete your account at any time. We may suspend or terminate your access to the Apps if you violate these Terms or if we discontinue the service.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Apps after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of New York and the United States, without regard to conflict-of-law principles.
